& Conditions
THE
FOLLOWING ARE THE TERMS & CONDITIONS
UNDER WHICH WE ACCEPT BOOKINGS.
The Client is deemed to be the individual commissioning the booking. The
Agency is VisABLE People at PO BOX 80 DROITWICH WR9 0ZE.
THE
WORKING DAY
Normal hours for a day's booking are a total of 8,
between 9am & 6pm, including lunch break. Where an assignment is booked
as a half day this is construed as being for up to 4 hours either for
the morning or for the afternoon.
OVERTIME
Overtime is charged @ time & a half from 6pm - midnight and 7am -
9am. Midnight - 7am @ double time, Bank holidays and Sundays @ double
time, Saturdays @ time & a half.
TRAVELLING
TIME
Charged @ the current rate from the Agency to the location of the assignment
and back. No charge within a 15 mile radius of the Agency.
FITTINGS/MAKEUP/HAIRDRESSING
Models' time charged @ 50% of the hourly rate
(min 2 hr)
USAGE
FEES : POSTERS/SHOWCARDS/PACKAGING
CD COVERS/ INTERNET WEBSITES.
Fees to be negotiated additionally, covering 1 year from shoot date for
UK use only, to be checked by Client at time of booking. Normally 6 X
hourly rate, minimum 3 X hourly rate if very restricted usage is agreed.
CANCELLATIONS
If the Client gives two working days notice of cancellation to the Agency,
the Client shall pay half the fee quoted for the assignment. Where the
Client gives 1 working day or less in notice, then it shall pay the full
fee quoted by the Agency.
Where the assignment is said to be "weather-permitting", the
first cancellation is chargeable at half the fee quoted unless the model
arrives at the booking, in which case the full fee quoted is chargeable.
If the booking is postponed where a new date is fixed and re-booked within
24hrs of the original booking the Client shall pay to the Agency half
the fee quoted for the original booking and shall at the date of the later
booking pay a new fee in respect of that booking.
RESTRICTIONS
ON A MODEL
Models are at liberty to work for competing clients unless an "exclusive
use" fee has been agreed with the Agency. It is the Client's responsibility
to check for possible conflicts.
CREDIT
Credit is only available to Accredited Account Customers. 10 days notice
is required to open an account which may be offered at the Agency's discretion.
AGENCY
SUPPLEMENT
An Agency supplement 20% of the total fee is chargeable on all fees, including
travel time and usage fees but excluding TV commercials.
INSURANCE
Neither the models or this Agency holds insurance cover for models at
assignments and Clients should make arrangements with their own insurers.
TV
COMMERCIALS
Equity regulations shall apply.
The Client shall pay travelling charges, Agency fees and any other charges
as set out in these terms & conditions. For prevailing charges please
refer to the Agency.
AGENCY
CHARGES
The Agency charge will include a booking fee, subject to negotiation,
not usually exceeding 25% of the total charge to the Client (but specifically
excluding the 20% Agency supplement chargeable to its clients). VAT at
the prevailing rate will be added to the invoice total.
PAYMENT
On all invoices, payment is required within 30 days of the invoice date
where a credit account has been agreed with the Agency, otherwise payment
in full is required on the day of the assignment. The Client commissioning
the booking remains solely responsible for payment. Any query regarding
an invoice must be notified in writing to the Agency within 7 days of
receipt of invoice. For accounts outstanding 60 days after the invoice
date, interest @2% per month will be charged on all amounts outstanding.
NOTICES
All notices are to be served in writing to the Agency address.
COMPLAINTS
Any complaint against a model must be made to the Agency within the first
2 hours of the booking and the Agency shall have no liability whatsoever
in respect of the Model's actions or suitability.
The
conditions and the contract shall not be deemed to create or evidence,
any agency or partnership between the Agency on the one hand and the Client
or any third party on the other.
The Client shall not be entitled to withhold or delay payment or exercise
any right of set-off whatsoever and howsoever arising or arisen which
might otherwise be available to it.
Whilst
making every effort to provide a satisfactory service, we cannot be held
ultimately responsible for the model's conduct nor for any loss, howsoever
caused.
These
conditions shall be construed in accordance with English Law and the English
Courts shall have exclusive jurisdiction to settle all disputes.
